After March 11, Your AI Chatbot's Wrong Answers Might Be a Federal Compliance Problem

The FTC publishes its official AI policy statement tomorrow. Most companies don't know this is happening. Their legal teams do. Under Executive Order 14178 — signed December 11, 2025 — every federal agency with consumer-facing enforcement authority had 90 days to clarify how existing law applies to AI systems. March 11 is that deadline. For the FTC, it means publishing an enforcement posture under Section 5 of the FTC Act: the prohibition on unfair and deceptive practices. The operative phrase in the policy: "truthful outputs." If your AI system gives customers wrong information, that's not a product bug anymore.
The compliance risk isn't your LLM. It's your documents.
Here's the argument nobody in the legal press is making: wrong answers from enterprise AI chatbots rarely come from the model. With proper RAG infrastructure, the LLM doesn't hallucinate — it retrieves from your documents and generates based on what it finds. The risk is what it finds.
Your return policy changed in November. The old PDF is still in the knowledge base. Your AI chatbot cites the old terms with complete confidence. Under the FTC's incoming framework, that's not a retrieval error. That's a potentially deceptive representation to a consumer.
Think about what enterprise document estates actually look like. Outdated pricing guides that someone forgot to delete. Three versions of the same onboarding policy, two of which are wrong. IT security procedures updated verbally in a team meeting that never made it into the written documentation. This is normal. Every organization over 50 people has it.
Under the old rules, this was a knowledge management problem: messy, annoying, occasionally embarrassing, though as Amazon learned this week, it can also cause massive outages. After tomorrow, operating an AI system on top of that document debt and serving its outputs to customers is a different kind of problem.
What the FTC policy actually covers
EO 14178 directed the FTC to explain how its existing Section 5 authority applies to AI-powered products across five domains. The one with real teeth for enterprise AI is Domain 5: AI Safety Claims and Capability Representations. This covers how companies represent the accuracy of their AI systems to users — and by extension, what those systems actually say.
The FTC isn't creating new law here — it's clarifying that existing law already covers this. No ramp-up period, no enforcement grace period, no "we're still figuring out the rules." Section 5 has existed since 1914. The FTC is explaining it applies to AI. Enforcement can begin March 12.
The fine structure is already established: $50,000 per violation, per the FTC's existing penalty framework (Digital Applied). For a customer-facing AI chatbot fielding hundreds of queries a day, "per violation" gets uncomfortable fast.
During the public comment period that closed February 7, the FTC received 4,200 submissions from industry. That's a lot of companies paying attention. The question is whether they're paying attention to the right variable.
Most compliance conversations about this policy have focused on AI disclosure — labeling AI-generated content, disclosing when an automated system made a decision. That's the easy part. The harder part is accuracy: what happens when your AI is honest about being an AI but wrong about your policies, your pricing, or your procedures. What compliance-ready AI infrastructure looks like
The enterprises that aren't sweating this policy right now aren't lucky. They built their AI systems on maintained, audited knowledge bases — not on static document dumps.
What that actually means in practice: accuracy is monitored continuously, not checked once at deployment. When a new policy file conflicts with an older one, the system flags it before the AI ever sees both versions as equally valid. Outdated content gets routed for update or deletion — documents have a shelf life, and the system tracks it. Every answer traces back to a specific, current source document, so if the FTC asks "how do you know your AI was giving accurate information?", there's an audit trail to show them.

The FTC publishes tomorrow. Enforcement can begin immediately after. The companies that will feel this first are the ones with customer-facing AI chatbots running on unmanaged, static knowledge bases — which, according to new DataHub benchmarks, describes the vast majority of enterprise AI deployments.
The question isn't whether your LLM is hallucinating. With RAG, it probably isn't. The question is whether the documents it's retrieving from are current, consistent, and accurate.
If the answer is "mostly" or "we haven't checked since we launched," that's the compliance exposure. Not the model. The filing cabinet behind it.
The businesses that treat their AI knowledge bases as a compliance asset — not just a search index — aren't just getting better answers. They're building the audit trail that demonstrates due diligence under Section 5. That's the difference between a UX upgrade and a legal defense.
